Information regarding the processing of personal data by Constract Export-Import sp.z o.o. for the Company's clients and contractors and their employees

Please be advised that to the extent that we contact you in connection with the conduct of business activity by Constract, we process your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, Official Journal of the EU L 119 of 04.05.2016) - hereinafter referred to as the Regulation.

1. Who is The Controller of your personal data?

The Controller of your personal data is Constract Export-Import limited liability company (hereinafter: Controller, Constract) with its registered office in Wałdyki, Wałdyki 23A, 14-229 Rożental, entered into the Register of Entrepreneurs of the National Court Register under the number KRS 0000161989, NIP(Tax Identification Number): PL7441473866 , REGON: 510693209, share capital: PLN 50,000.

2. How to contact the data controller?

You can contact us in matters related to the processing of your personal data by sending a letter to the address of Constract, indicated above or by sending an electronic message to the address: biuro@constract.pl.

3. What is the purpose of processing your personal data?

Your personal data is processed for the purpose of conducting business by Constract, selling our products, concluding and implementing contracts concluded by the Company, and maintaining contacts with clients, contractors and suppliers. The detailed scope of personal data processed by us as well as the legal basis for their processing may vary depending on the purpose for which we process it:

       A. Personal data of Constract's potential clients and contractors

We process personal data of natural persons who are potential clients of the Company as well as potential suppliers, subcontractors, contractors or service providers who may provide services to the Company in the future. In this case, the data processing process begins before the formal establishment of cooperation and includes the search for contractors, business talks and negotiations as well as the preparation or submission of an offer. These data are processed in order to establish business cooperation and to conclude a contract. If you belong to this group and you propose to cooperate with the Company, the data is processed on the basis of art. 6 clause 1 letter b) of the Regulation, which says that the controller may process personal data, when it is necessary in order to take steps at the request of the data subject prior to entering into a contract. If the initiative to conclude a contract and start business cooperation comes from Constract, we process your personal data on the basis of art. 6 clause 1 letter f) of the Regulation, which speaks of the possibility of data processing in situations where it is necessary for the purposes of the legitimate interests pursued by the controller. Establishing cooperation with clients, contracting parties, suppliers, subcontractors, service providers or contractors is just such a legitimate interest of the Company.

       B. Personal data of the Company's clients and contractors

We process the personal data of our clients and contractors with whom we cooperate - such as natural persons purchasing our products or services, contractor suppliers, service providers providing services to the Company or subcontractors. If you are a person from this group, your personal data will be processed on the basis of art. 6 clause 1 point b) Regulation, which says about the possibility of processing personal data if it is necessary for the performance of a contract to which the data subject is party. In addition, we may process the personal data of our clients or contractors for purposes related to the implementation of obligations imposed on the Company by law, e.g. tax law. In this case, the processing of personal data takes place on the basis of art. 6 clause 1 letter c) of the Regulation. In some cases, we may process your personal data in order to implement the legitimate interests of the Company, such as pursuing claims or defending against claims. In this case, the basis for the processing of personal data is the provision of art. 6 clause 1 lit. f) of the Regulation, which indicates the possibility of processing data in a situation where it is necessary for the purposes of the legitimate interests pursued by the controller.

Ponadto, możemy przetwarzać dane osobowe naszych Klientów lub Kontrahentów w celach związanych z realizacją obowiązków nałożonych na Spółkę przepisami prawa, np. prawa podatkowego. W takim przypadku przetwarzanie danych osobowych następuje na podstawie przepisów art. 6 ust. 1 lit c) Rozporządzenia.

W niektórych przypadkach możemy przetwarzać Pani/Pana dane osobowe w celu realizacji prawnie uzasadnionych interesów Spółki, takich jak dochodzenie roszczeń czy też obrona przed roszczeniami. W takim przypadku podstawą do przetwarzania danych osobowych jest przepis art. 6 ust. 1 lit. f) Rozporządzenia, który wskazuje na możliwość przetwarzania danych w sytuacji gdy jest to niezbędne do realizacji prawnie uzasadnionych interesów administratora.

       C. Personal data of employees and associates of the Company's clients or contractors

We also process personal data of employees or associates of our clients and contractors (suppliers, service providers, contractors, subcontractors), as well as potential clients or contractors. They include, for example, data of employees of companies with whom we are conducting negotiations regarding the conclusion of a contract, we are bound by contracts or we conduct trade exchange. If you are such a person, we would like to inform you that your personal data is processed in order to establish cooperation with your employer or principal or to execute between him and the Company. This is the legitimate interest of Constract, and the data is processed on the basis of art. 6 clause 1 letter f) of the Regulation, which indicates the possibility of processing data in a situation where it is necessary for the purposes of the legitimate interests pursued by the controller.

4. Where do we have your personal data from and what categories of data do we process?

We receive the personal data of clients or contractors (including potential ones) directly from these persons, entities or from publicly available sources, e.g. a website regarding your business activity. These data may include identification data, contact details, data on conducted economic cooperation and data on financial settlements. Data of employees of entities with which Constract cooperates, i.e. employees of clients / contractors include identification data, contact details and data of the workplace. We obtained them directly from you or your employer.

Dane pracowników podmiotów z którymi współpracuje Constract, czyli pracowników klientów/kontrahentów obejmują dane identyfikacyjne, dane kontaktowe oraz dane o miejscu pracy. Pozyskaliśmy je bezpośrednio od Pani/Pana lub od Pani/Pana pracodawcy.

5. How long will your personal data be processed?

Your personal data will be processed for the following time:

       A. Data processed for the purpose of conducting trade negotiations, submitting offers, etc.

If negotiations are underway concerning the conclusion of a contract with the Company - for the duration of these talks and for a period of up to one year from the date of their termination, however, when cooperation with the Company is established, they will be processed in accordance with the provision indicated in point 5B.

       B. Data processed in the case of conducting business cooperation

If you are a party to the contract concluded with the Company - for the duration of this contract and until the expiry of the limitation period for claims arising from it, as a rule, 3 years after the end of cooperation. Data regarding financial settlements are stored for a period of 5 years from the end of the tax year in which the accounting documents or financial operations were issued, in accordance with the content of tax regulations.

       C. Data of employees of Customers or Contractors

If you are an employee or associate of our client or contractor, we will process your personal data for the duration of cooperation with the client or contractor and until the expiry of the limitation period for claims arising from such cooperation, usually 3 years after team work.

6. Who do we share your personal data with?
Your personal data may be disclosed to external entities, such as:
       A. provider of electronic mail hosting services for the Company,
       B. entities providing the Controller with advisory and auditing services, legal assistance or assistance in the field of taxes and accounting
       C. entities conducting postal or courier activities

7. What are your rights related to the processing of personal data?

You have the right to:
       A. access your personal data and correct it,
       B. request the restriction of the processing of your data,
       C. request to delete personal data,
       D. request the transfer of personal data,
       E. to the extent that the data is processed on the basis of the legitimate interest of the controller - objecting to the processing of your personal data.

In addition, if you consider that personal data is being processed unlawfully, you have the right to lodge a complaint with the supervisory authority.

8. Other information
Refusal to provide data may result in the inability to conclude or perform a contract with the Company. Please be advised that your data will not be processed in an automated manner, including they will not be used for profiling.
